Red Tape on Isla Mujeres

On Isla Mujeres, indeed for that matter, the whole of Mexico and South America, there is endless governmental red tape; some believe this is designed to keep the disproportionate number government employees in work.

Whatever the reason, those from other cultures find it hard to adapt to the number of forms and endless rules, regulations and requirements here on Isla Mujeres. Whilst the island is relaxed and restful, keeping up with the paperwork and requirements is not.

Mexico’s laws are based on the Roman system, introduced by the Spaniard’s when they invaded Mexico in 1519. The Spanish improved some things in Mexico; whilst at the same time plundering the country, and making off with vast quantities of Mexican gold.

Those who buy property on Isla Mujeres are surprised to learn that they are not buying their property either as freehold or leasehold but in a Fideicomiso which is a trust. In doing so there is In practice little difference from buying freehold; a Fideicomiso lasts for fifty years, after which, or any time before, it can be renewed, passed to one’s children or sold. That is how all Americans or others who are not Mexican nationals purchase land and property. There is an alternative which is to buy the property in a company, but that can be very expensive.

Buying property is usually Americans first brush with Mexico’s complicated laws; the next stage is if they decide to rent out their property. Previously (perhaps up until five to ten years ago) when someone wanted to rent out their Isla Mujeres home, it was just a matter of advertising it. Many of those renting property were not paying taxes and it wasn’t long before Isla Mujeres town hall realized there was a large source of untapped income in granting permissions and fining those who don’t have the right paperwork.

Some of the town hall’s requirements for those who are renting their property are sensible, such as fire extinguishers, smoke alarms, fire exit signs and emergency lighting. Other requirements are bordering on absurd, such as lifesaving and resuscitation courses that have to be attended by all employees, and having a dedicated life saver for the pools. Even although when properties are rented, there is probably not a member of staff within a mile of the pool. However in spite of the red tape which does take some getting used to, you will find owning Isla Mujeres property a great experience.
